1. Who we are

BSV Business is a B2B gift card aggregator through which qualified business clients may purchase digital products sourced from third-party brand issuers. BSV acts solely as distributor, reseller, or intermediary and does not issue Gift Cards.
2. Relationship to other contracts
These are Website terms, not a supply contract for Gift Cards, API access, or prepaid balance. If executed, the Client Agreement and NDA prevail over these Terms for their subject matter. These Terms continue to govern public use of the Website.
3. Eligibility and business use only
The Website and BSV Business are offered to businesses, not consumers. You represent that you are at least 18, have authority to bind your organisation, will use the Website lawfully, and are not a Sanctioned Person or located in a Restricted Territory.
We may refuse access requests, sandbox access, or accounts, including after KYC/KYB review.
4. The Website, Portal, and API
Marketing pages and catalogue coverage are illustrative. Live SKUs, regions, availability, and prices are available only after access is approved through the portal or API. Production API use requires a signed Client Agreement, completed KYC/KYB, and applicable fees. Evaluation or sandbox access does not authorise live resale or production orders.
5. Access requests and onboarding
Requesting access through forms.bsvmarket.com/signup or by email is an invitation to treat, not an offer we must accept. We may request KYC/KYB documents, beneficial-ownership information, intended use, corridors, and technical details. Submission creates no API rights, prepaid account, or commitment on price or catalogue.
6. Accounts, credentials, and security
- Keep Access Credentials confidential and use them only through authorised personnel.
- Do not embed secrets in public repositories or client-side applications.
- Do not use development keys in production.
- Production API access may be restricted to submitted IP addresses.
- You are responsible for activity under your credentials until we receive notice of compromise and have a reasonable opportunity to act.
Notify [email protected] immediately if credentials or related systems may be compromised. We may impose rate limits, throttling, volume caps, or other restrictions.
7. Acceptable use
You must not use the Website, portal, or API fraudulently or unlawfully; probe vulnerabilities or bypass security controls; scrape or bulk-extract data outside authorised API methods; reverse engineer confidential materials; disrupt systems; submit false requests or orders; exploit pricing or stock weaknesses; build a competing platform using BSV Confidential Information; share access; or misrepresent BSV as a Merchant or issuer.
We may suspend or restrict access where we reasonably believe there is fraud, security risk, sanctions exposure, an intellectual-property complaint, legal breach, or material non-payment.
8. Catalogue, pricing, and content
Brand, category, volume, and coverage statements are descriptive marketing, not warranties or offers. The live Catalogue may change without notice, including prices, discounts, denominations, regions, availability, limits, and eligible territories.
Current Product Pricing must be retrieved from the API immediately before each order. Merchant terms, redemption instructions, and exclusions may also change without notice.
9. Orders, delivery, and funds
Commercial ordering is governed by the Client Agreement. Orders are accepted only when fulfilment is confirmed; delivered Gift Cards are generally non-cancellable and non-refundable; risk passes on delivery; fulfilment may take up to 48 hours or longer during maintenance, stock constraints, Merchant delays, or force majeure.
A prepaid balance is required in advance. Top-ups must be sent only to bank accounts or cryptocurrency addresses notified through official email. BSV does not guarantee redemption, Merchant solvency, store acceptance, or continued availability. Until a Client Agreement is in force, the Website does not enable production purchases.
10. Intellectual property
Rights in the Website, API, portal, software, databases, pricing logic, documentation, and BSV branding remain BSV's property. Merchant names, logos, artwork, and product content remain the property of the relevant Merchant or licensors. You may not copy, modify, frame, or republish them except as expressly permitted in writing.
11. Confidentiality
Non-public business, technical, financial, or security information disclosed in demos, onboarding, or documentation is Confidential Information. If an NDA is signed, it governs. API documentation, credentials, catalogue structure, and pricing mechanics are confidential even if not marked.
12. Sanctions, AML, and prohibited channels
You must comply with applicable AML/CFT, sanctions, export-control, and anti-bribery laws. You must not use BSV Business, Gift Cards, or the API for fraud, money laundering, unlicensed gambling, sanctions evasion, or resale through unapproved channels.
13. Privacy
Personal data is processed as described in the Privacy Policy. Do not send unnecessary End User personal data to BSV.
14. Disclaimers
THE WEBSITE, DOCUMENTATION, CATALOGUE INFORMATION, SANDBOX, AND RELATED MATERIALS ARE PROVIDED “AS IS” AND “AS AVAILABLE”.
To the maximum extent permitted by law, BSV disclaims warranties including merchantability, fitness for purpose, non-infringement, accuracy, uninterrupted availability, redemption, and Merchant performance. Marketing statements do not create service-level or certification warranties unless expressly stated in a signed Client Agreement.
15. Limitation of liability
Nothing excludes liability for fraud, fraudulent misrepresentation, wilful misconduct, or liability that cannot be limited by law. Subject to that, BSV is not liable for indirect or consequential damages, Merchant refusal or redemption failure, IP claims relating to Materials, downstream resale, force majeure, third-party failures, or your systems.
For Website use and these Terms only, BSV's aggregate liability shall not exceed USD 500. A Client Agreement's liability provisions prevail for API access, orders, delivery, and resale.
16. Indemnity
You shall defend, indemnify, and hold harmless BSV and its affiliates, directors, officers, employees, and agents from losses arising from your breach, misuse of the Website or Materials, resale or marketing of Gift Cards, IP claims, violation of law or Merchant terms, unauthorised credentials, fraud, scam, or abuse.
17. Suspension and termination
You may stop using the Website at any time. We may suspend or terminate access immediately for breach or where we reasonably believe there is a security, reputational, or compliance risk. On termination of a Client Agreement, API use must cease and unused balances are handled under that agreement.
18. Changes
We may amend these Terms by posting an updated version and changing the “Last updated” date. Material changes take effect when posted or on a later date specified. Continued use after the effective date constitutes acceptance.
19. Governing law and disputes
These Terms are governed by the laws of the United Arab Emirates as applied in Dubai. Disputes shall be finally resolved by arbitration under the DIAC Arbitration Rules, with seat in Dubai and proceedings in English. BSV may seek injunctive relief for IP misuse, security breaches, or unauthorised use.
20. General
These Terms, the Privacy Policy, and any executed NDA or Client Agreement form the entire agreement for their subject matter. Severability, no waiver, assignment restrictions, no partnership, English-language precedence, and formal-notice provisions apply.
